🇬🇧The U.K.’s Highest Court Tackles AI Patent Dispute

On Wednesday, the U.K.’s highest court ruled AI models can’t be listed as inventors on a patent application.

Key Details:
  • The cases originated in 2018, when Stephen Thaler submitted various patent applications ranging from a food packaging shape to a flashlight variant.

  • Rather than listing himself as the inventor, Thaler cited an AI model called “DABUS.”

  • The U.K. Intellectual Property Office initially claimed he failed to comply with patent stipulations requiring a person to be the inventor.

  • Thaler appealed the decision in the U.K.’s High Court and Court of Appeal, maintaining he met all the requirements under the 1977 patent legislation.

  • The Supreme Court ruled that under existing patent law, the identified “inventor” must be a “natural person.”

Why It’s Important:
  • This decision implies that AI-powered tools and machine outputs don’t pass the patent process. As a result, autonomous inventions aren’t protected under the law.

  • Tim Harris, a patent litigator at Osborne Clarke, stated: “If it had been Dr. Thaler’s case that he was the inventor and had used DABUS as a highly sophisticated tool, the outcome of the proceedings might have been different.”
