🏛California Proposes AI Regulation “SB 1047”

California State Senator of District 11 Scott Wiener proposed “SB 1047,” an aggressive AI safety regulation framework that faces backlash from companies like OpenAI and Anthropic.

Key Details:
  • “SB 1047” proactively aims to prevent Large Language Models (LLMs) from causing “critical harms” against humanity.

  • It imposes transparency obligations that require developers to disclose technical details about their LLMs.

  • It also forces developers to add emergency stop buttons that turn off LLMs in seconds.

  • “SB 1047” creates a new enforcement agency called the Board of Frontier Models (BFM).

  • A developer’s Chief Technology Officer (CTO) must submit an annual report to the BFM outlining the company’s AI safety protocols and AI developments.

  • If an “AI safety incident” occurs, the developer must report it to the BFM within 72 hours of learning about it.

Why It’s Important:
  • “We have a history with technology of waiting for harms to happen,” said Wiener. “Let’s not wait for something bad to happen. Let’s get out ahead of it.”

  • OpenAI and Anthropic argue that “SB 1047” prematurely stifles innovation by supporting a robust regulatory regime for AI developments before the technology causes harm.

  • Geopolitical observers note that overly cautionary regulation may give China the time to usurp the U.S. in the AI arms race.
