OpenAI published a blog responding to The New York Times filing a lawsuit against them over abusing the newspaper’s intellectual property to train large language models.
Key Details:
OpenAI claims training AI models using publicly available internet materials is fair use, as supported by academics, startups, creators, and authors.
OpenAI also offered a simple opt-out process for publishers to prevent the startup from scraping their data, which The New York Times enabled in August 2023.
The blog also argues The New York Times manipulated prompts to construct regurgitated outputs of dated articles multiplied on third-party websites.
The news source tried partnering with OpenAI in December to create a “real-time display with attribution in ChatGPT” to connect with existing readers and reach new audiences.

Google attended court in Boston to challenge a computer scientist’s claim that the company owes him $1.67 billion for using his patents to build processors for AI systems.
Key Details:
Founder of Singular Computing, Joseph Bates, told junior associates that Google copied his technology after several meetings with Google to discuss solutions to computing challenges.
Bate’s attorney, Kerry Timbers, claims his client communicated his computer-processing innovations with Google in 2014.
Internal emails showcase Google’s current chief scientist, Jeff Dean, writing: “Bate’s ideas could be well suited for what we’re developing.”
Google lawyer Robert Van stated Bates is a “disappointed investor” and “Google’s chips are fundamentally different from what’s described in Singular’s patents.”
