On Wednesday, The New York Times filed a lawsuit against Microsoft and OpenAI over abusing the newspaper’s intellectual property to train Large Language Models (LLMs).
Key Details:
The media outlet claims the companies copied content verbatim without permission to train OpenAI’s ChatGPT and Microsoft’s Bing Search models.
The New York Times explained: “These tools were built with and continue to use independent journalism and content only available because we reported, edited, and fact-checked it at high costs with considerable expertise.”
In the lawsuit, the Times alleged OpenAI’s GPT-4 model “directly competes with Times content.”
A filing displayed OpenAI’s GPT-4 model generating nearly identical text outputs to articles about predatory lending methods in the taxi industry.
Why It’s Important:
Susman Godfrey, the litigation firm that represented Dominion Voting Systems against Fox News for a $786.50 million settlement, is pursuing OpenAI and Microsoft for using copyrighted material without permission.
Microsoft will claim AI models fall under transformative use (i.e., add new expression, meaning, or messaging to the original work) and bypass copyright law.

🍎Sam Altman Poaches Lead Apple Designer

OpenAI CEO Sam Altman and former Apple designer Jony Ive reportedly poached Apple’s vice president of design, Tang Tan, to build AI hardware.
Key Details:
Tang Tan, vice president of iPhone and Apple Watch product design, will join Ive’s LoveFrom studio as the lead hardware engineer for AI-powered devices.
LoveFrom is a creative collection of designers, architects, musicians, filmmakers, writers, engineers, and artists designing advanced AI products.
LoveFrom acquired 20 former Apple employees after a multi-year consulting deal with Apple ended in 2022.
Altman was briefly fired by OpenAI’s board of directors in November, partly because of his fundraising campaigns for side projects like Ive’s LoveFrom design firm.
Why It’s Important:
LoveFrom has assembled a roster of high-profile clients, including Airbnb Inc., Ferrari NV, and Moncler SpA.
Apple’s brain drain continues as they lose talented and skilled employees to LoveFrom. The startup might become Apple’s biggest rival in AI hardware.
